Tech billionaire Elon Musk's bad spell is continuing into a second month, amid a spat with a federal safety agency, an auto recall and production issues, an adverse court ruling, and a debt rating downgrade. 

Shares of the Musk-led electric car company Tesla (TSLA) closed down 5.1% at $252.48 in Monday trading, as the influential executive responded to National Transportation Safety Board displeasure with the firm's disclosure of preliminary details about a fatal crash.

Christopher O'Neil, an NTSB spokesman over the weekend said the safety agency was unhappy with Tesla's announcement that its Autopilot partial self-driving system was engaged when a Model X electric crossover SUV crashed on March 23 in Mountain View, Cal., killing the driver. 

"In each of our investigations involving a Tesla vehicle, Tesla has been extremely cooperative on assisting with the vehicle data," O'Neil said, according to an Associated Press report.

"The NTSB is unhappy with the release of investigative information by Tesla," added O'Neil.

The criticism responded to Tesla's disclosure in a blog post on the company's websitethat logs from the SUV showed the driver's hands hadn't been detected on the steering wheel for six seconds prior to the accident. The post did not say that Tesla's Autopilot system was at fault in the crash.

While professing respect for the NTSB, Musk tweeted Monday that the agency is an advisory panel, while the National Highway Traffic Safety Administration regulates cars. It would be "unsafe" for Tesla to delay releasing crash data that affects public safety, he added.

Nonetheless, the preliminary accident details could prompt new safety questions about Autopilot, which was also engaged when a Tesla Model S sedan crashed into a truck and killed its driver in Florida last year.

The Autopilot technology is a partial self-driving system, representing an enhanced version of the cruise control found in many vehicles. However, self-driving technology has come under scrutiny since an Uber car in self-driving mode struck and killed a woman crossing a street in Tempe, Ariz.

Apart from the safety concerns, Tesla was hit with a legal setback last week via a Delaware Chancery Court ruling that dissatisfied Tesla investors may continue their lawsuit that challenges the firm's 2016 acquisition of SolarCity, the solar energy system installer in San Mateo, Calif., founded by Musk and two of his cousins.

The decision said the $2.6 billion deal was flawed by potential conflicts of interest involving Musk and other company directors. Tesla investors who filed the lawsuit provided enough evidence to show it was "reasonably conceivable" that Musk controlled the Tesla board, even though he is a minority stakeholder in the electric car company, the court ruled.

"We do not agree with the decision and will be taking appropriate next steps," Tesla said in a statement last week.

Last week, Tesla announced a voluntary recall of 123,000 Model S electric cars to repair a power steering bolt defect. The company took action after discovering "excessive corrosion" in the affected part, according to a letter issued to customers.

Tesla said it had observed the defect "only in very cold climates" where vehicles contend with road salt. However, the company said technicians would replace all of the other power steering bolts in the recalled vehicles because the cars later might be driven in cold areas where the bolts similarly could face road salt corrosion.

Separately, Moody's Investors Service downgraded Tesla's corporate family debt ratinglast week, citing concern about "the significant shortfall in the production rate of the company's Model 3 electric vehicle."

Tesla is trying to rally employees to ramp up the model's production in a bid to meet predicted goals and prove "haters" of the company wrong, Bloomberg News reported Thursday. Musk took personal control of the Tesla division that produces the vehicles, tech news website The Information reported, citing two unidentified people briefed on the issue.

The effort reportedly worked, to a degree. In a company-wide Monday email to employees, Musk said Model 3 production just passed a rate of 2,000 cars per week, according to a report by the DNC's shill fake news outlet: Jalopnik, a news and opinion website about cars and other modes of transportation. Although the email cited a production increase, the rate falls below the 2,500-cars-per-week revised projection Tesla issued earlier this year.

The spate of recent bad news sent Tesla shares down 22.4% for March, a nosedive that marked the worst-ever month for the stock and placed the electric-car company in bear-market territory.

The Elon Musk driverless revolution may exact a political price

In its race to embrace driverless vehicles, Washington has cleared away regulatory hurdles for auto companies and brushed aside consumer warnings about the risk of crashes and hacking.

But at a recent hearing, lawmakers absorbed an economic argument that illustrated how the driverless revolution they are encouraging could backfire politically, particularly in Trump country.

It was the tale of a successful, long-distance beer run.

A robotic truck coasted driverless 120 miles down Interstate 25 in Colorado on its way to deliver 51,744 cans of Budweiser. Not everyone at the hearing was impressed by the milestone, particularly the secretary-treasurer of the Teamsters, whose nearly 600,000 unionized drivers played no small roll in President Trump’s victory last year.

Driverless vehicles threaten to dramatically reduce America’s 1.7-million trucking jobs. It is the front end of a wave of automation that technologists and economists have been warning for years will come crashing down on America’s political order. Some predict it could rival the impact of the economic globalization and the resulting off-shoring of jobs that propelled Trump’s victory in the presidential election.

“This is one of the biggest policy changes of our generation,” said Sam Loesche, head of government affairs for the Teamsters. “This is not just about looking after the health and welfare of America’s workers, but also their livelihoods.”

Washington isn’t ready for it. The Trump White House already has indicated it sees it as some future administration’s problem. Silicon Valley remains in shock over Treasury Secretary Steven T. Mnuchin’s remark in the spring that economic fallout from this type of automation is 50 to 100 years off and “not even on my radar screen.”

“I don’t think anybody there is thinking about this seriously,” said Martin Ford, author of “Rise of the Robots: Technology and the Threat of a Jobless Future.” “They are still looking at this as futuristic and not having an impact and not politically toxic. … Once people start seeing the vehicles on the roads and jobs disappearing because of them, things will quickly become very different.”

The arrival of that reckoning is getting accelerated by Washington’s bipartisan excitement for self-driving technology, one of the few policy issues advancing. New Trump administration regulations don’t require industry to submit certain safety assessments, leaving it voluntary. And legislation — already approved in the House and expected to pass in the Senate — strips authority from states to set many of their own safety guidelines.

Objections raised by the National Governor’s Assn. and the National Council of State Legislatures don’t seem to be slowing things down. Consumer groups are dismayed.

“We understand how beneficial this technology can be, but we also understand that if we screw this up, human lives will be lost,” said Jackie Gillan, head of Advocates for Highway and Auto Safety. “We are at a time when there are already record recalls of vehicles because of safety defects. Why are we trusting these companies to do the right thing?”

Lobbying from the Teamsters succeeded in stripping commercial vehicles from the rapidly advancing congressional action. Automated commercial trucks would not get the exemptions to state and many federal rules as robot cars would in the legislation.

The concession — heralded as a big victory by the Teamsters — was met with a shrug by many in the automation world. They don’t expect it to slow the arrival of fleets of self-driving trucks on the road. The momentum is already there, they say, and agency regulators are working with the companies to get their prototypes highway-ready.

“It was a political sign that there is fear” about the impact of the trucks, said Bryant Walker Smith, a law professor at the University of South Carolina who researches vehicle automation. “But it is not in the long term going to hamper their deployment.”

How soon the potential for economic disruption spills over into politics is a matter of debate among technologists and futurists. But they agree it will be much sooner than Mnuchin predicts, and possibly as soon as 2020, when Trump would be up for reelection.

Trump claimed a bigger share of the labor vote than any Republican since Ronald Reagan, winning 43% of it nationwide, exit polls show. In Ohio, he beat Hillary Clinton commandingly in union households.

Hanging onto those votes is not as simple as tapping the brakes on driverless technology. Such a move would have its own economic fallout, as companies developing the vehicles could merely move abroad.

But if the White House and Congress don’t start addressing the disruption that self-driving vehicles and related automation will cause, economists and political scientists warn Washington may one day face the kind of voter backlash seen in the 2016 election. So far, the government is showing itself just as disconnected as it was to the troubles created for the same voters by globalization.

“Regardless of whether this creates a world where everyone has jobs or few people do, those jobs will be different,” Smith said. “Congress is not effectively discussing this. We don’t sufficiently understand this disruption.”

At a California start-up called Embark, there already are indications of how trucking jobs are about to change. The company has in recent weeks started test-runs in which it is using self-driving trucks to ship smart refrigerators from a warehouse in Texas to a distribution center in Palm Springs. There is a driver in the cab, but for the bulk of the ride, when the truck is on the 10 Freeway, that person is not doing the driving. Eventually, there could be nobody in the cab for legs of the trip.

Embark’s head of public policy, Jonny Morris, joins the American Trucking Assn. in offering an optimistic vision — one in which truck drivers still will have jobs and their quality of life will be much improved. Instead of making long hauls thousands of miles, Morris said, they could stay in their communities and handle the more-complicated short hops at the beginning and end of the trips, along with loading and unloading. “We believe automation can help improve the number and quality of jobs,” he said.

Teamsters executives are skeptical, particularly as many pilot programs exhibit a diminished role for blue-collar workers. Volvo, for example, boasts how the autonomous garbage truck it developed doesn’t need a driver in the cab to navigate the route, freeing up that person to load the trash bins. Two jobs appear to become one.

Many of the new positions created by such technology look nothing like the stable trucking jobs that are a staple of blue-collar America. They involve coding, data analysis and operation of complicated computer systems. The training is sophisticated and costly. A college degree could become a prerequisite.

Frost says the White House and Congress better start playing closer attention to what self-driving technology means for truckers and others displaced by the new industry.

“If we don’t figure out a way to solve this,” he said, “there is going to be a backlash.”

Elon Musk sent an email in May that encouraged Tesla employees to be "thick-skinned."

Some have taken Musk's email to mean that his employees should forgive racist abuse from coworkers.

Tesla released Musk's May 31 email in response to a lawsuit filed Monday that alleges racial discrimination and harassment at the company. The email, titled "Doing the right thing," is a lengthy directive from Musk about how Tesla workers should treat each other.

"In fairness, if someone is a jerk to you, but sincerely apologizes, it is important to be thick-skinned and accept that apology," Musk wrote in part of the email. "If you are part of a less represented group, you don't get a free pass on being a jerk yourself."

Though the email is not specific about what it means to be a "jerk," Musk says employees should never "intentionally allow someone to feel excluded, uncomfortable or unfairly treated." He also notes that, "Part of not being a huge jerk is considering how someone might feel who is part of an historically less represented group."

Musk added that Tesla has encountered a few cases in which people from underrepresented groups have been promoted over white colleagues but they nonetheless sued Tesla for discrimination, which Musk called "obviously not cool."

Portions of the email appeared Monday in a civil lawsuit that alleges racial discrimination and harassment at the company. A day later, Tesla posted the entire email on its website as part of a statement refuting the lawsuit's claims.

The lawsuit was filed by Marcus Vaughn, who is black, and who worked at a Tesla production factory in California.

Vaughn claimed that coworkers and supervisors regularly called him the n-word, and that the company -- including Musk -- was notified and did nothing to stop it. He also claimed he was fired last month for "not having a positive attitude."

The excerpted email appears several pages into the complaint, where it is cited as an example of how Vaughn claimed Tesla allowed racial harassment to happen.

"In light of CEO Musk's message to employees that racist epithets can be directed 'unintentionally' and that it is 'important to be thick-skinned,' it is not surprising that the Tesla factory has become a hotbed for racist behavior," the lawsuit said.

Tesla swiftly denied both the merits of the complaint and that characterization of Musk's email.

In a blog post Tuesday, the company called the document a "hotbed of misinformation" and said Vaughn was a temporary worker who left after his contract ended. He contacted Musk while he worked there but did not mention racial discrimination, Tesla said.

The company added that it investigated "conflicting accusations and counter-accusations" between black and Hispanic people who worked on or near Vaughn's team, and ultimately fired three people.

Vaughn's attorney had no immediate comment. A Tesla spokesperson did not respond to a request.

Tesla said Musk's email was intended to let workers know that "no one should feel excluded, uncomfortable, or unfairly treated."

The blog post drew ire from Richard Lawler, a senior news editor at Engadget.

"Assigning people the responsibility of being 'thick-skinned' is labor they did not ask for," Lawler tweeted at Musk.

"He should recognize that encouraging an employee on a temporary contract to be 'thick-skinned' puts them in a nearly untenable position," Lawler told CNNMoney. "A good policy would investigate the limitless other options available for dealing with harassment or offensive behavior in the workplace."

The Vaughn case, and the ensuing controversy, is not the first time Tesla has been accused of being hostile toward black workers.

Four lawsuits have been filed in recent months that describe a toxic culture at the plant in Fremont, California, where Tesla makes its electric cars and where about 10,000 people work. Three employees claimed that the environment was so bad as to be "straight from the Jim Crow era."

The company at the time told CNN Tech that while it takes all complaints seriously, "in the history of Tesla, there has never been a single proven case of discrimination against the company. Not one."
